Instructions for the Issuance of the Certificate of Good Practices Labor Electronically

On March 14, 2023, Ministerial Agreement No. 104 was published in the Official Gazette.

2023 of the Ministry of Labor and Social Welfare in which it is agreed to reform Ministerial Agreement 64-2021 “Instructions for the Issuance of the Certificate of Good Labor Practices electronically” called “BPL Certificate”.

Below is a brief summary of it:

The Occupational Risk Prevention Plan or Occupational Health and Safety Plan, as applicable, must be registered with the Department of Health and Safety.

Occupational Health of the Ministry of Labor and Social Security or by the Safety and Hygiene Section of the Guatemalan Institute of Social Security. 

The Directorate of Promotion of Labor Legality will be the one who issues the “BPL Certificate” when the employer complies with all the requirements established within the instructions, the certificate will be valid for one (1) year, it is in charge of receiving, analyzing and verifying of the requests that contain the documents sent by employers electronically, being able to indicate priors, reject the request or issue the corresponding certificate. 

The Certificate of Good Labor Practices, issued by the Directorate for the Promotion of Labor Legality, will cease to be valid when the employer fails to comply with current labor regulations, as long as said failure is duly confirmed. Verified through the General Labor Inspection and has become final in accordance with the legal procedures in force or upon completion of the validity period of the certificate that has been extended, for which the General Labor Inspection must notify the Responsible Body.

Ministerial Agreement 324-2022 of the Ministry of Labor and Social Security dated August 12, two thousand and twenty-two is repealed.

The Ministerial Agreement came into force on March 14, 2023.
